1. Who you're contracting with

These Terms govern your use of ProLister (the "Service"). The Service is provided by Saar Cohen, an individual seller based in Thailand, operating under the trading name "ProLister" ("ProLister", "we", "us"). You can reach us at saarcohen1911@gmail.com. By creating an account or using the Service you agree to these Terms. If you're using the Service on behalf of an organization, you confirm you have authority to bind it.

2. The Service

ProLister is an AI-powered tool that enhances real-estate photos — lighting, color, sharpness, perspective, and clarity — so property owners, hosts, and agents can turn everyday phone photos into clean, listing-ready images for real-estate marketplaces, rental platforms, and property websites. ProLister enhances the presentation of your space; it never adds, removes, or fabricates features of the property. The Service is provided on a pay-per-credit basis. Credits do not expire.

3. Acceptable use

You agree not to:

• Use the Service unlawfully, fraudulently, or to send spam.
• Upload content you don't have the rights to, or that infringes any third-party IP.
• Upload illegal content, content depicting minors inappropriately, hateful, or violent imagery.
• Attempt to reverse engineer, scrape, probe, or interfere with the Service or its security.
• Resell or redistribute the Service or its outputs as a standalone product.

4. AI outputs — your responsibility

You're responsible for the photos you upload and how you use the enhanced outputs. You confirm you own or have permission to edit and publish those photos. AI enhancements may not always be accurate or suitable for every use case — review outputs before publishing them. We may remove, restrict, or refuse to process content that violates these Terms, and we may suspend accounts for repeated infringement.

5. Your account

Keep your login credentials confidential — you're responsible for activity under your account. Provide accurate information and keep it up to date.

6. Intellectual property

ProLister owns the Service, including all software, models, branding, and documentation. You retain ownership of the photos you upload. You grant us a limited license to host and process those photos solely to provide the Service to you.

7. Payments and refunds

Payments for ProLister credits are processed securely by our payment provider, Stripe. By making a purchase you also agree to Stripe's applicable terms. Prices are shown in US dollars and are exclusive of any taxes that may apply in your jurisdiction; you are responsible for any such taxes. All purchases are final — credits are non-refundable once purchased and orders cannot be cancelled after checkout. See our Refund Policy for full details.

8. Service availability

We work hard to keep ProLister running, but we don't guarantee uninterrupted or error-free performance. The Service is provided "as is" and, to the fullest extent permitted by law, we disclaim all implied warranties (including merchantability and fitness for a particular purpose).

9. Suspension and termination

We may suspend or terminate your access for material breach of these Terms, non-payment, security or fraud risk, or repeated/serious policy violations. On termination, your right to use the Service ends; we may delete your account data after a reasonable period.

10. Liability

To the fullest extent permitted by law, our total aggregate liability arising out of or relating to the Service is capped at the fees you paid us in the 12 months before the claim. We are not liable for indirect, consequential, or special damages (including lost profits, data, or goodwill). Nothing in these Terms limits liability for fraud, death, or personal injury where the law does not allow it.

11. Changes

We may update these Terms. If changes are material, we'll notify you. Continued use of the Service after changes means you accept the updated Terms.
